Terms of Service
1. About Us
Digiwizr (“we”, “us”, “our”) is a digital services business operating at digiwizr.com. These Terms govern your use of our website and the purchase of our services. References to “you” or “the Client” mean the individual or entity engaging our services.
2. Services
Digiwizr provides digital services including, but not limited to: website design and development, SEO auditing and optimisation, content writing, social media management, Google Business Profile optimisation, and digital advertising setup.
The specific deliverables, timeline, and pricing for any engagement are agreed in writing via email or a project brief, before work commences. No work begins without written confirmation of scope and payment terms.
3. Ordering and Agreement
An agreement between you and Digiwizr is formed when you:
- Submit a project enquiry and receive written confirmation of scope and pricing from us, and
- Pay the required deposit or full project fee as specified
We reserve the right to decline any project or enquiry at our discretion without obligation to provide reasons.
4. Pricing and Payment
- All prices are quoted in United States Dollars (USD) unless otherwise agreed in writing
- A 50% deposit is required before work commences on any project valued above $100
- The remaining 50% balance is due upon delivery of the final work
- Projects valued at $100 or under require full payment upfront
- Digital product purchases from our shop require full payment at the time of purchase
- We accept payment via PayPal, bank transfer, and major credit/debit cards
- Invoices not settled within 7 days of the due date may result in work being paused until payment is received
5. Delivery and Timelines
Estimated delivery times are provided in good faith at the time of project confirmation. Timelines begin from the date of deposit receipt and the provision of all required materials by the Client. Delays caused by late provision of materials, feedback, or approvals from the Client may extend the delivery timeline accordingly.
We will notify you promptly if an unforeseen circumstance affects the agreed timeline.
6. Revisions
Every project includes one round of revisions as standard. A revision round means one consolidated set of feedback submitted after delivery. Additional revision rounds beyond what is included are available at a rate of $45 per hour, agreed in writing in advance.
Revisions are limited to modifications of the original agreed scope. New features, additional pages, or substantially different directions constitute a change of scope and will be quoted separately.
7. Client Responsibilities
To enable us to deliver your project on time and to the agreed standard, you agree to:
- Provide accurate, complete, and timely information required for the project
- Respond to requests for feedback, approval, or materials within 5 business days
- Ensure you hold all necessary rights, licences, and permissions for any materials (text, images, logos, trademarks) you provide to us
- Comply with all applicable laws in connection with your use of our deliverables
We accept no liability for delays or deficiencies arising from the Client’s failure to meet these responsibilities.
8. Intellectual Property
Upon receipt of full payment, all agreed final deliverables become your property. Until full payment is received, all work remains the intellectual property of Digiwizr.
We retain the right to display completed work in our portfolio, case studies, and marketing materials unless you request in writing that we do not. Any such request must be made within 14 days of project delivery.
We retain ownership of any proprietary frameworks, methodologies, tools, or processes used in creating your deliverables. Third-party assets (stock images, fonts, plugins) remain subject to their respective licences.
9. Confidentiality
Both parties agree to keep confidential any sensitive business information disclosed during the project engagement and not to share it with third parties without prior written consent. This obligation survives termination of the project agreement.
10. Cancellation
You may cancel a project at any time by notifying us in writing. Cancellation terms are as follows:
- Before work commences: Full deposit refunded less any administration costs incurred
- After work has commenced: The deposit is non-refundable. Any work completed up to the cancellation date will be invoiced at a pro-rata rate against the total project value
- Digital products: Non-refundable once accessed or downloaded

11. No Guarantee of Results
We apply industry best practices and genuine professional effort to all work. However, we cannot and do not guarantee specific business outcomes, including but not limited to search engine rankings, website traffic levels, social media follower growth, advertising performance, or revenue increases. These outcomes depend on numerous factors outside our control, including third-party algorithm changes, market conditions, and the Client’s own business activities.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Digiwizr’s total liability for any claim arising from or related to our services shall not exceed the total amount paid by you for the specific project giving rise to the claim.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunities, whether arising in contract, tort, or otherwise, even if we have been advised of the possibility of such damages.
13. Indemnification
You agree to indemnify and hold harmless Digiwizr from any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising from your use of our deliverables in violation of applicable law or third-party rights, or from materials you provided that infringe third-party intellectual property.
14. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with generally accepted international commercial principles. In the event of a dispute, both parties agree to attempt to resolve it in good faith through direct negotiation before pursuing any formal legal remedy.
15. Changes to These Terms
We reserve the right to update these Terms at any time. The updated version will be posted on this page with a revised effective date. Continued use of our services after changes are posted constitutes your acceptance. We will notify active clients of material changes by email.
